These House Rules are subject to change, revision, supplementation, interpretation, and enforcement by Landlord or Landlord’s Authorized Agent based on operational needs, resident behavior, repeated rule violations, neighbor complaints, safety or security concerns, property conditions, maintenance needs, legal or regulatory requirements, and the overall quiet enjoyment and welfare of the House community. Notice of updates may be given by written notice, posted notice, email, text message, or group chat announcement, and compliance is required upon the effective date of the notice.

Resident quick guide: most important daily rules

This quick guide is provided for convenience and highlights the rules most likely to affect day-to-day life in the House. It does not replace the full House Rules below.

(1) Guests and gatherings: Residents are responsible for their guests at all times. Gatherings involving 5 or more non-residents require advance approval. Quiet Hours apply to all gatherings, and existing residents’ use of the House always takes priority over any guest or event.

(2) Quiet Hours and noise: Keep noise to a reasonable level at all times. Quiet Hours are 11:00 p.m. to 8:00 a.m. Sunday through Thursday and 1:00 a.m. to 10:00 a.m. Friday through Saturday.

(3) Kitchen and dishes: Clean your dishes promptly. Under the 24 Hour Rule, Dishes may be moved and later disposed of. If kitchen conditions become unsanitary, including mold, pests, insects, bacteria, or foul odors, management may intervene immediately without waiting for the full 24-hour periods.

(4) Bathrooms and shared spaces: Bathrooms and all common areas must be used considerately and left in a reasonably clean condition so other residents can use them.

(5) Security and access: Lock doors and windows to your room when leaving. Do not admit non-residents unless you are personally present and responsible for them.

(6) Electronic lock batteries and lockouts: Pay attention to low-battery warnings on electronic locks and inform the onsite manager promptly. If you fail to report a low-battery issue and management must handle the resulting locksmith service, you may be charged the full applicable cost.

(7) Fees and consequences: Certain violations may result in charges, including unauthorized gatherings, kitchen cleanup, lockouts, lost keys, locksmith service, damages, and other resulting costs where permitted by the Lease and applicable law.

(8) Raising concerns: If problems are not being addressed, residents may use the private Resident Issue Report form or contact Landlord directly. Residents may leave their name blank, but identifying detail can help management act.

1.1 Smoking, alcohol, and controlled substances

Landlord wishes to maintain a safe and healthy living environment in the House. Therefore, Resident shall abide by the following rules regarding smoking, vaping, alcohol, and illegal drugs:

(a) Smoking and vaping: Resident shall not smoke or vape any substance on the House premises, including tobacco and cannabis. This rule protects the health and safety of all residents and it applies to all areas of the House, including all common areas and outdoor areas such as the open patio in the front of the House, the parking lot of the House and the roof deck of the House.

(b) Alcohol: Alcohol is permitted on the premises only for residents and guests who are 21 years of age or older. Resident shall not permit or participate in any underage possession or consumption of alcohol, furnish alcohol to any person under 21, engage in drinking games, or cause any disruptive intoxication or alcohol-related nuisance on the premises.

(c) Illegal Drugs/Controlled Substances: Resident shall not possess, use, manufacture, sell, distribute or consume any illegal and/or dangerous drugs on the House premises. Resident also may not induce others to possess, use, manufacture, sell, distribute or consume any illegal and/or dangerous drugs on the House premises. Any suspected activities with respect to illegal and/or dangerous drugs shall be reported to the Berkeley Police Department.

1.2 Health, safety, and quiet enjoyment

Resident shall not behave in a manner that threatens the health, safety, or quiet enjoyment of Resident or other residents in the House. Such violations of the Rules shall include, but are not limited to, the following:

(a) Participation in disturbances caused by others that threaten the health, safety or quiet enjoyment of other residents;

(b) Harassment and/or behavior that is, in the reasonable opinion of Landlord or Landlord’s Authorized Agent, disorderly, disruptive, lewd, abusive or threatening;

(c) Throwing, dropping, or launching objects or material into or out of the House;

(d) Possessing firearms or other dangerous devices or weapons, as defined by the California Penal Code, with or without a permit, anywhere on the premises of the House;

(e) Stealing or using without authorization of another resident’s personal property or Landlord’s property, equipment or resources; and

(f) Forcibly enter into any private room without the permission of the licensed occupant thereof.

1.3 Noise and quiet hours

Resident must keep noise to a reasonable level at all times as a courtesy to other residents and the neighboring community. Resident shall be considered to have violated the Rules if Resident creates unreasonable noise that does or could reasonably do any of the following:

(a) Disrupt another resident’s sleep, rest, work, study, or quiet enjoyment of the House;

(b) Disrupt the neighboring community;

(c) Create amplified sound from any device, speaker, subwoofer, television, phone, computer, or musical instrument during Quiet Hours, defined as 11:00 p.m. to 8:00 a.m. Sunday through Thursday and 1:00 a.m. to 10:00 a.m. Friday through Saturday. On nights before major school holidays, Quiet Hours shall follow the Friday-Saturday schedule; and

(d) Create amplified sound in outdoor areas, unless Resident first obtains written consent from Landlord or Landlord’s Authorized Agent and any permit required by local authorities. No amplified outdoor noise shall be permitted during Quiet Hours.

For clarity, unreasonable noise is prohibited at all times, 24 hours a day, 7 days a week, and not only during Quiet Hours.

1.4 Fire safety

Resident shall respect all measures and procedures with respect to Landlord’s fire safety measures. Resident shall have violated the Rules by doing the following:

(a) Failing to evacuate the House immediately upon the sound of a fire alarm or failing to follow specific evacuation and safety procedures;

(b) Misusing or tampering with any fire safety equipment including, but not limited to, removing fire doors or closures, smoke detectors, and fire extinguishers;

(c) Possessing explosives or flammable substances on the House premises, including but not limited to firecrackers, gasoline, lamp oil, or toxic chemicals;

(d) Using candles, incense, or any other device that requires an open flame;

(e) Using halogen lamps;

(f) Operating any cooking appliances in Resident’s room, including without limitation any microwave oven, toaster oven, electric boiling kettle, coffee maker, electric rice cooker, or electric stove;

(g) Operating any high-voltage or high-wattage equipment that could overload the House’s power system; and

(h) Using Resident’s own refrigerator in Resident’s room without Landlord’s prior approval.

1.5 Guests and gatherings

Residents are responsible for their guests at all times.

(a) Any gathering involving 5 or more non-residents requires approval from Landlord or Landlord’s Authorized Agent at least 7 days in advance;

(b) Gatherings attended only by existing residents do not require advance notice;

(c) Any request for approval of a gathering must include the number of non-resident guests, whether the event is open to all house residents or private, the start and end time, and the areas of the House that will be used;

(d) Social events are encouraged for the benefit and enjoyment of residents. The House may not be used as an event venue, and private events are more likely to be denied if they are likely to create a nuisance for existing residents;

(e) Approval is not automatic and remains at Landlord’s discretion;

(f) Unapproved gatherings that require advance approval shall be documented and escalated immediately;

(g) During any gathering or event, existing residents’ use of the House and common areas shall be prioritized and may not be denied, restricted, or unreasonably interfered with, even if prior authorization for the event has been given. The needs of existing residents always take precedence over another resident’s guests or event plans, and this principle shall guide any accommodations, approvals, or discussions relating to events;

(h) Quiet Hours apply to all gatherings;

(i) Residents who organize social gatherings at the House assume all liability and responsibility for any damages resulting from the event, including clean-up costs;

(j) In order to account for trash expenses related to such events, there is a Fifty Dollar ($50.00) charge for any approved event with more than ten non-resident guests;

(k) Any gathering requiring advance approval that occurs without approval shall be subject to an unauthorized event charge of One Hundred Fifty Dollars ($150.00) to cover administrative and operational burden, in addition to any cleaning, trash-hauling, repair, security-response, or other resulting costs;

(l) Any approved or unapproved gathering that results in unusual trash accumulation, extra cleaning, damage, noise complaints, or management intervention shall be subject to all resulting costs, including a reasonable administrative charge; and

(m) No person who has been evicted from the House or terminated by Landlord shall be allowed to return to the House as a guest.

1.6 Pets

Resident may not keep pets of any kind anywhere on the House premises unless otherwise explicitly permitted by Landlord.

1.7 Security and keys

Landlord has designed the House to be a safe and secure environment for all residents. In order to maintain such security, Resident must abide by the following:

(a) Key Policy:

(1) Resident shall be responsible for the safekeeping of all keys given to him or her that operate locks to the House or parts thereof. Resident shall retain possession of these keys at all times until he or she returns them to Landlord;

(2) Resident shall not make, possess or allow to be made any duplication of any of Landlord’s keys, including but not limited to any room keys or master keys;

(3) Resident must immediately report any lost keys to Landlord. If, as a result of these lost keys, Landlord decides that it is necessary to change the locks to the House and/or to Resident’s room, Resident shall be charged the cost of such changes in the locks; and

(b) Guests shall only be admitted if the hosting Resident is personally present at the House. Resident shall not admit anyone into the House who is not his or her guest. Guests may not use resident amenities such as laundry or storage without approval. Landlord may require guests to sign a logbook or provide personal particulars prior to entry into the House;

(c) Resident shall be responsible for locking all doors and windows to his or her Designated Space before leaving the House. Resident shall also make sure that any exit to the House is also properly locked before leaving the House;

(d) Resident shall report any suspicious activity to Landlord; and

(e) Resident should not keep any valuable personal property in the House such as gold and jewelry. Landlord shall not provide any safe to store such valuables and Landlord shall not be responsible for any loss or damage to Resident’s valuables, or to provide insurance for such losses, due to theft or any other cause.

1.8 Restricted areas, parking, and damage

(a) Resident may not enter into any area that has been designated or marked by Landlord as restricted;

(b) Resident’s lease for the Designated Space does not include a parking space in the parking lot of the House. Parking is offered, if available, for an additional monthly fee of One Hundred Fifty Dollars ($150.00). Only vehicles displaying an authorized parking permit shall be permitted to park on the premises. Unauthorized vehicles, including vehicles belonging to Resident’s guests, shall be subject to a Seventy-Five Dollar ($75.00) per day charge to the responsible Resident. If no Resident can be associated with the vehicle, the vehicle may be towed, booted, or stickered at the vehicle owner’s expense;

(c) Resident may not tamper with, or use, any facility, equipment or system of the House that is clearly marked for Landlord’s use only;

(d) Resident may not vandalize or intentionally damage any area of the House. This includes, but may not be limited to removal of any signs and intentionally littering the common areas; and

(e) Resident shall not change the lock to his or her Designated Space. Landlord shall perform any lock change to a Designated Space.

1.9 Kitchen and dishes

(a) Resident shall not remove any equipment or utensils used for the preparation or serving of meals from the kitchen or the dining room. Such equipment or utensils may include, but not be limited to, flatware, plates, bowls, glasses, mugs and trays;

(b) Resident shall clean his or her own dishes, flatware, tray, and dining area at the conclusion of his or her meal, and return his or her own dishes, flatware, and tray to the kitchen cabinet prior to leaving the dining room;

(c) Landlord may move and dispose of dirty dishware, equipment, utensils, etc. ("Dishes") according to the following rules ("24 Hour Rule"):

(1) Landlord may announce the 24 Hour Rule upon visual inspection of an accumulation of Dishes in common areas.

(2) 24 or more hours after announcement of the 24 Hour Rule, Landlord may move Dishes to a location near the communal trash bins in the Kitchen. These Dishes shall then be considered marked for disposal.

(3) 24 or more hours after Dishes have been marked for disposal, Landlord may dispose of the Dishes. No recovery or reimbursement shall be provided by Landlord.

(d) If Resident leaves dishes, food waste, or kitchen mess in violation of these Rules and Landlord must perform or arrange cleanup beyond ordinary housekeeping, Resident shall be responsible for all resulting cleanup, hauling, pest-control, and administrative costs.

(e) A kitchen-cleanup fee of Twenty-Five Dollars ($25.00) may be charged for the first documented violation during the lease term requiring management cleanup after notice, and Fifty Dollars ($50.00) for each subsequent documented violation during the lease term. This fee applies in addition to disposal of Dishes under the 24 Hour Rule and is intended to cover administrative time and management handling. Any Resident responsible for Dishes disposed of under the 24 Hour Rule may be charged the applicable kitchen-cleanup fee.

(f) Notwithstanding the 24 Hour Rule, if Dishes, food waste, or related kitchen conditions are causing or reasonably likely to cause mold, pests, insects, bacteria, foul odors, or other unsanitary or hazardous conditions, Landlord or the onsite manager may move, isolate, clean, or dispose of the affected items immediately, without waiting for the 24-hour periods to expire. Resident(s) responsible shall remain liable for any resulting cleanup, hauling, pest-control, remediation, and administrative costs, to the extent permitted by the Lease and applicable law.

1.10 Room cleanliness

Resident shall reasonably attempt to keep his or her Designated Space clean and orderly.

1.11 Bathrooms

All bathrooms in the House are considered shared facilities. Resident shall be considerate of others who need to use the bathroom. Resident shall try not to occupy the bathroom for an excessively long time and shall clean up after his or her use.

All semi-private bathrooms are considered shared facilities exclusive to the Residents of their conjoining rooms.

1.12 Inspections

Landlord shall have the right to inspect Resident’s Designated Space if Landlord reasonably suspects that Resident has violated the Rules. Prior to inspecting Resident’s Designated Space, Landlord shall give Resident proper notice as required in the Lease.

1.13 Lockouts and key fees

Resident is responsible for maintaining house and room keys.

(a) Standard lockouts: If Resident is locked out of the House or room and requires a door to be unlocked by management, there is a service charge of Fifty Dollars ($50.00) from 9:00 a.m. to 5:00 p.m. and One Hundred Dollars ($100.00) after hours.

(b) Lost or unreturned keys: If original keys are lost, required to be remade, and/or are not returned at the end of the lease, Resident shall be charged a fee of Fifty Dollars ($50.00).

(c) Resident-arranged locksmith: Resident has the right to call a locksmith to open doors; however, Resident shall be responsible for all associated costs and any resulting damage and shall be required to provide a key to Landlord if the room lock is re-keyed.

(d) Electronic lock battery monitoring: Resident is solely responsible for monitoring the battery status of the electronic lock for the room, if available. A low-battery warning includes the lock giving high-and-low beeps after entry of a valid code, the Schlage button briefly flashing red and then green, and a slight delay before the door unlocks. A critically low battery warning includes the Schlage button blinking red even when no code has been entered, at which point the keypad may no longer open the lock.

(e) Notice and replacement obligation: Resident must promptly inform the onsite manager upon any low-battery warning and must seek immediate replacement upon any critically low battery warning. Landlord or the onsite manager may, in Landlord’s discretion, replace the battery directly or require Resident to obtain and install an approved replacement battery immediately. If management handles battery replacement because Resident failed to act promptly after notice or warning, Resident may be charged the actual resulting cost, to the extent permitted by the Lease and applicable law.

(f) Battery-related access failure: If Resident fails to give notice of a low-battery condition and a locksmith or other service is required to open the door as a result, Resident shall be solely responsible for all associated costs and any resulting damage. The standard lockout service charges in subsection (a) do not apply to management-handled locksmith service made necessary by Resident’s failure to report a low-battery condition. If Resident wishes management to handle the locksmith service in that circumstance, Resident shall pay the full locksmith charge of Three Hundred Dollars ($300.00). Otherwise, Resident may call a locksmith directly and shall be solely responsible for arranging such service and paying all associated costs.

1.14 Resident disputes

Resident may have dispute(s) with other resident(s) of the House. Resident shall first attempt to settle any such dispute(s) with the other resident(s) without the assistance of Landlord. If such dispute(s) are severe and cannot be settled informally, Landlord may take reasonable steps to protect the House and its residents, including mediation or reassignment where permitted by the Lease, and may charge responsible Resident(s) for resulting costs where allowed by the Lease and applicable law.

1.15 Responsibility for consequences

Resident shall be responsible for all actual damages, cleanup costs, repair costs, administrative charges, fines, and legal costs, to the extent permitted by the Lease and applicable law, resulting from Resident’s breach of these Rules or the conduct of Resident’s guests.

1.16 Compliance with management directives

Resident shall comply with reasonable written or verbal directives issued by Landlord or the onsite manager regarding safety, cleanliness, access, guests, noise, maintenance coordination, and use of common areas, provided such directives are consistent with the Lease and applicable law.

1.17 Reporting concerns and unresolved violations

If any Resident believes these Rules are being violated and that the issue has not been adequately addressed, Resident may submit a report through the private Resident Issue Report form or report the issue directly to Landlord. Residents may leave their name blank if preferred, but lack of identifying detail may limit management’s ability to verify the report or take action. Landlord may investigate and take such action as Landlord deems appropriate, subject to the Lease and applicable law.
